1.2 By accessing or using our website, you agree to comply with and be bound by these T&Cs. If you do not agree with these T&Cs, please do not use our website.
1.3 We reserve the right, at our sole discretion, to refuse or remove listings that do not meet our standards or comply with these T&Cs.
2. Definitions
2.1 “User” refers to anyone who uses our website, including estate agents, property owners, and their representatives.
2.2 “Listing” refers to the details and information about a property that is uploaded to our website by a User.
2.3 “Services” refers to the services provided by us through the website, including property listings, advertising, and other related services.
3. Eligibility
3.1 By using our website, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these T&Cs.
4. User Accounts
4.1 Account Creation: Users must provide a valid email address to use certain features of our website. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4.2 Email Verification:
- To access certain features, you must verify your email address by entering the verification code sent to you.
- For modifications to your Listings, you will need to re-verify your email address by entering a new verification code sent to your email.
4.3 Confidentiality: You are responsible for maintaining the confidentiality of verification codes sent to your email address and for all activities that occur under your verified email. If you believe that your email account has been compromised, you must notify us immediately.
4.4 Security Measures: While we implement appropriate measures to protect the email verification process, the security of your email account remains your responsibility.
4.5 Identity Verification
- We reserve the right to request proof of identity or authorization to verify that Users have the legal right to list properties on our platform. This may include providing government-issued identification, proof of ownership, or other documentation as necessary.
- Failure to provide requested verification within the specified timeframe may result in account suspension or removal of Listings.
5. Listings
5.1 User Responsibility: Users may create Listings for properties they have the legal right to list for sale or rent. By submitting a Listing, you confirm that you:
- Have obtained all necessary permissions for the Listing.
- Comply with applicable property regulations, including:
- Energy Performance Certificates (EPCs): Properties must meet UK EPC requirements.
- Building Regulations: Properties must comply with all relevant building and planning permissions.
- Right to Rent Checks: Users offering rental properties must ensure compliance with the UK Right to Rent regulations.
5.2 Accuracy: Listings must be accurate, complete, and not misleading. Material inaccuracies, misrepresentations, or omissions may result in the rejection or removal of the Listing. Submissions that are incomplete—such as those missing required images, essential details, or verification—may also be rejected or removed at our sole discretion.
5.3 Prohibited Content: Users must not upload any content, including images, that:
- Promotes hate speech, violence, or discrimination.
- Contains obscene, pornographic, or defamatory material.
- Encourages illegal activity or violates any laws.
- Harasses, abuses, or intimidates others.
5.4 Advertising Standards Compliance: Users must adhere to the UK Advertising Standards Authority (ASA)regulations, ensuring that:
- All advertisements and Listings are truthful and substantiated.
- No material facts are omitted that may mislead potential buyers or renters.
5.5 Discretionary Publishing and Removal: We reserve the right, at our sole discretion, to refuse to publish or remove any Listing that:
- Violates these T&Cs.
- Fails to comply with property regulations or advertising standards.
- Contains inappropriate content.
We are under no obligation to provide a reason for refusing to publish or removing a Listing.
5.6 Indemnity for Compliance: Users agree to indemnify us against any claims or legal liabilities arising from non-compliance with property-related regulations.
5.7 Reporting Fraudulent or Incorrect Listings
- Users are responsible for ensuring the accuracy and legality of the Listings they submit.
- If a User becomes aware of a fraudulent, incorrect, or unauthorized Listing on the website, they must notify us immediately by contacting [email protected].
- We reserve the right to investigate and take necessary action, including removing the Listing, suspending the User account, or reporting the matter to relevant authorities.
- Users submitting fraudulent Listings may face legal consequences and indemnify us for any resulting claims or damages.
5.8 International Listings
- Users submitting Listings for properties located outside the United Kingdom must ensure compliance with all applicable local property laws, including ownership verification, advertising regulations, and other legal requirements.
- We do not guarantee compliance of international Listings with UK or local laws. It is the User’s responsibility to ensure that their Listings adhere to the relevant regulations of the country in which the property is located.
- We reserve the right to reject or remove Listings from jurisdictions with insufficient regulatory frameworks or high fraud risks.
5.9 Fraudulent Activity and User Verification
- We implement measures to monitor and reduce fraudulent activity on our platform, but Users are responsible for ensuring that their Listings are truthful, accurate, and lawful.
- Users submitting Listings may be required to provide additional information or documentation to verify their identity or authority to list the property. Failure to provide such information upon request may result in suspension or removal of the Listing.
- Users agree to indemnify us against any losses or claims arising from fraudulent or unauthorized Listings.
5.10 Legal Compliance
- Users are solely responsible for ensuring that their Listings comply with all applicable laws and regulations, including but not limited to:
- Property ownership verification requirements.
- Local advertising and consumer protection laws.
- Building and safety regulations.
- We are not responsible for verifying the accuracy or legality of Listings. By submitting a Listing, you agree to indemnify us for any claims or liabilities arising from non-compliance with applicable laws.
5.11 Listing Quality Standards:
- All listings must adhere to our quality standards, which include but are not limited to:
- Providing high-quality, clear, and relevant images that accurately represent the property.
- Ensuring property details are accurate, complete, and free from misrepresentation.
- Complying with all applicable legal, regulatory, and advertising requirements.
- Listings that fail to meet these standards may be rejected or removed at our sole discretion.
6. Fees and Payments
6.1 Overview
6.1.1 Some Services, including property listings, are subject to fees.
6.1.2 Fees are payable either:
in advance, when you purchase prepaid listing credits (“Credits”) via our Stripe-powered payment system; and/or
in arrears, when you are billed on a pay-as-you-go (“PAYG”) basis through Stripe for listing activity not covered by Credits.
6.1.3 By using our Services, you authorise us (and our payment provider, Stripe) to charge you for Credits and any applicable PAYG usage in accordance with this Section 6.
6.2 Definitions
6.2.1 Listing means a property listing that is published on London Development Sites and visible to visitors in one or more chargeable categories (for example “For Sale” or “To Let”).
6.2.2 Listing Month means a billable period during which a Listing is live and chargeable. For each Listing we track a first billable date and a next renewal date in your agent portal.
6.2.3 Credits are prepaid units that can be used to pay for Listing Months.
6.2.4 PAYG means pay-as-you-go billing where we charge a per-Listing, per-month fee when Credits are not available.
6.2.5 Chargeable Categories are categories in which Listings may incur Credits or PAYG charges (for example “For Sale” and “To Let”).
6.2.6 Non-chargeable Categories are categories used to pause billing for a Listing, such as “Sold”, “Let”, “Sold / Let”, “Unavailable”, “Auction” and “Auctions” (or other similar categories we may use from time to time).
6.3 Credits and pricing
6.3.1 Credits are required to pay for Listing Months in chargeable categories. One Credit generally allows one property Listing to be live for approximately one month (one Listing Month).
6.3.2 Our current introductory pricing for Credits (exclusive of VAT and subject to change) is:
£10 (plus VAT) — 1 Credit (1 property listing for 1 month);
£40 (plus VAT) — 5 Credits (e.g. 5 properties for 1 month, or 1 property for 5 months, or any combination);
£180 (plus VAT) — 30 Credits (e.g. 30 properties for 1 month, or 5 properties for 6 months, or any combination).
6.3.3 Larger credit packs provide discounted effective rates compared to purchasing single Credits.
6.4 How Credits are used
6.4.1 A Credit is consumed in full when a Listing Month starts. This may occur when:
a Listing is first published in a chargeable category; and/or
a Listing reaches its renewal date while it remains published in one or more chargeable categories.
6.4.2 Credits are used per Listing and per Listing Month. Once a Credit has been used for a Listing Month, it is:
not refundable,
not divisible (no partial credits), and
not transferable to another Listing.
6.4.3 If you unpublish a Listing or move it only into Non-chargeable Categories part-way through a Listing Month, the Credit for that month remains fully used. No part of that month’s Credit is carried over or re-used.
6.4.4 If you re-publish the same Listing into chargeable categories before its next renewal date, the Listing continues under the same paid Listing Month and no additional Credit is consumed until the next renewal date. If you re-publish it after the renewal date has passed, a new Listing Month may begin and an additional Credit may be consumed (or PAYG may apply if Credits are not available).
6.5 Credit expiry
6.5.1 Each credit pack has an expiry date, typically 12 months from the date of purchase (the exact expiry may be shown at the point of purchase or in your agent portal).
6.5.2 Any unused Credits in a pack expire on the pack’s expiry date and are forfeited. Expired Credits cannot be used, refunded or exchanged.
6.5.3 We may, but are not obliged to, send reminder emails (for example 30-day and 7-day warnings before expiry). These reminders are provided as a convenience only. It remains your responsibility to monitor your credit balance and expiry dates.
6.6 PAYG billing (when Credits are not available)
6.6.1 If, when a Listing Month is due for a Listing, you do not have sufficient Credits available, that Listing Month may be billed on a PAYG basis.
6.6.2 Our current PAYG rate is £10 (plus VAT) per Listing per month (subject to change as set out in clause 6.9).
6.6.3 PAYG is calculated per Listing Month, not pro-rata by day. If a Listing is removed, unpublished, or moved into Non-chargeable Categories part-way through a Listing Month, the PAYG charge for that month is not refunded or reduced.
6.6.4 While a Listing remains only in Non-chargeable Categories, no new PAYG billing occurs for that Listing.
6.6.5 PAYG usage is aggregated and invoiced via Stripe in arrears, typically on a monthly billing cycle. The timing of PAYG invoices, and the detail of the PAYG units charged, will be shown on your Stripe invoice(s).
6.7 Order of use: Credits first, then PAYG
6.7.1 When a Listing Month is due:
We will first attempt to use any available Credits for that Listing;
If there are not enough Credits to cover that Listing Month, it may be billed on a PAYG basis at the then-current PAYG rate.
6.7.2 Credits and PAYG months are recorded per Listing. Your agent portal may show, for each Listing, how many Listing Months have been covered by Credits and how many by PAYG.
6.8 Behaviour of Sold / Unavailable / paused Listings
6.8.1 Moving a Listing into one or more Non-chargeable Categories (such as “Sold”, “Let”, “Sold / Let”, “Unavailable”, “Auction” or “Auctions”) pauses future billing for that Listing from the point of change.
6.8.2 Any Credit or PAYG unit already consumed for the current Listing Month remains used and will not be refunded.
6.8.3 If a Listing is returned from Non-chargeable Categories into chargeable categories:
and its current Listing Month has not yet reached the renewal date, no extra unit is charged until that renewal date;
and its current Listing Month has already passed the renewal date, a new Listing Month may start and a new unit (Credit or PAYG) may be charged.
6.9 Changes to prices, Credits and PAYG rates
6.9.1 We reserve the right to adjust at any time:
the prices of Credits and credit packs;
the number of Credits included in each pack;
PAYG rates; and
any promotional or introductory pricing.
6.9.2 Changes will apply only to future purchases and future PAYG usage. Credit packs you have already bought will retain the number of Credits that applied when you purchased them.
6.9.3 Where reasonably possible, we will provide notice of material changes to PAYG rates or pack structures (for example via email or notices in your agent portal), but we are not obliged to maintain any particular price or promotion beyond its stated period.
6.10 Taxes and currency
6.10.1 All prices are quoted in pounds sterling (GBP) and are exclusive of VAT, unless explicitly stated otherwise.
6.10.2 VAT is charged at the applicable UK rate and will be added to the total price at checkout or shown on your Stripe invoice(s).
6.11 Refunds and non-cancellable fees
6.11.1 Except where required by law, all fees are non-refundable, including but not limited to:
purchased Credits (used or unused);
expired Credits;
partially used Listing Months; and
PAYG charges already incurred or invoiced.
6.11.2 We do not provide pro-rata refunds if you remove a Listing, mark it as sold or unavailable, or otherwise cease using a Listing part-way through a Listing Month.
6.11.3 Nothing in this Section 6 affects any statutory rights you may have as a consumer or business under applicable law.
7. Permissible Use
7.1 Users agree to use our website only for lawful purposes and in compliance with these T&Cs.
7.2 Users agree not to:
- Violate any local, national, or international laws or regulations.
- Exploit, harm, or attempt to exploit or harm minors.
- Transmit unsolicited or unauthorized advertising or promotional material.
- Impersonate Register a Property, its employees, or other users.
- Interfere with the website’s operation or misuse its features.
- Use any automated means to access or interact with the website, including but not limited to bots, scrapers, and spiders.
8. Intellectual Property
8.1 All intellectual property rights in and to our website and its content are owned by us or licensed to us. These rights are protected by intellectual property laws.
8.2 Users may not reproduce, modify, or distribute website content without prior written consent.
8.3 You retain ownership of any content you submit to the website. However, by submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display that content for the purpose of operating the website and providing our services.
9. Disclaimers
9.1 No Affiliation with Government Bodies
Register a Property is an independent platform and is not affiliated with HM Land Registry, any government department, or any legal property registration authority. We do not conduct or process legal title registration. Users are responsible for ensuring their property ownership is correctly registered through the appropriate legal channels, such as HM Land Registry.
9.2 Platform Responsibility: We provide a platform for property Listings but are not responsible for verifying compliance with property regulations. Users are solely responsible for ensuring their Listings comply with applicable UK laws.
9.3 No Warranties: The website and Services are provided on an “as is” basis without warranties, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.
9.4 Third-Party Links: This website may contain links to third-party websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites.
9.5 No Refund Policy: Payments made for listing credits are strictly non-refundable. Credits must be used within the platform as intended and cannot be exchanged for cash or transferred.
10. Limitation of Liability
10.1 To the fullest extent permitted by law, we are not liable for:
- Losses arising from reliance on Listings or information on the website.
- Unauthorized access to data.
- Technical disruptions or website unavailability.
- Any indirect, incidental, special, consequential, or punitive damages.
10.2 Our total liability to you is limited to the fees paid for our Services.
11. Indemnification
11.1 Users agree to indemnify and hold harmless Register a Property, its affiliates, employees, and agents from claims, damages, or liabilities arising from:
- Violations of these T&Cs.
- Non-compliance with property regulations or advertising standards.
- Misleading or inaccurate Listings.
- Your use of the website and services.
- Claims or disputes arising from the rejection or removal of a listing due to non-compliance, poor quality, or other reasons.
12. Termination
12.1 We may suspend or terminate User accounts immediately for any violations of these T&Cs or misuse of the platform.
13. Governing Law
13.1 These T&Cs are governed by the laws of England and Wales. Any disputes shall be resolved in English courts.
13.2 International Use
- Our website is intended for use primarily within the United Kingdom. Users accessing our website from outside the UK are responsible for compliance with local laws and regulations.
- Any disputes arising from Listings or the use of our website will be governed by the laws of England and Wales, regardless of the User’s location.
14. Changes to Terms
14.1 We may update these T&Cs at any time. Updates will be effective upon posting on this page. Users are advised to review the T&Cs periodically.
